GENERAL GUIDELINES



The San Andreas State Penal Code is the official documentation of all the laws in the state. All citizens are required to abide by these laws. Law enforcement officers are here to enforce the law, meaning that they're still required to follow it as well.

The State Penal Code is divided in Titles, Sections and Subsections.

Example of this: Title 1, Section 3, Subsection 02 (T-1,(3),02)

Law enforcement officers are required to follow all the regulations stated by the penal code. When charging civilians, a LEO must:


Correctly spell the charge.
Calculate the total time a person will spend in jail or prison.
Must NOT stack the same charge multiple times.


Failure to follow these regulations will result in serious consequences.

TITLE 1 - CRIMES AGAINST THE INDIVIDUAL




(1)01 - ASSAULT

Assault is defined as any physical attack on another individual with the intention of one person causing harm to another.

(1)02 - BATTERY

Battery is defined as a use of physical force against another individual which results in serious harm or damages upon the person.

T-1(1)02 is a misdemeanor which can get you a maximum of 15 minute(s) in a local jail.


(1)03 - ASSAULT WITH A DEADLY WEAPON

Assault with a deadly weapon is defined as use of any tool or equipment during a physical attack on another individual.

T-1(1)03 is a felony which can get you a maximum of 20 minute(s) in the state correctional facility


(1)04 - INTIMIDATION

Intimidation is defined as making another individual feel threatened or in any sort of danger. This includes death threats and any sort of verbal abuse on another individual.

T-1(1)04 is a misdemeanor which can get you a maximum of 5 minute(s) in a local jail.


(1)05 - ATTEMPTED MURDER

Attempted murder is defined as any unsuccessful attempt to take someone else's life by use of intentional force or tools.

T-1(1)05 is a felony which can get you a maximum of 30 minutes in the state correctional facility


(1)06 - MURDER

Murder is defined as unlawfully and intentionally taking someone else's life.

T-1(1)06 is a felony which can get you a maximum of 120 minute(s) in the state correctional facility.


(1)07 - MANSLAUGHTER

Manslaughter is defined as unlawful and unintentional killing of another individual. The person committing this act must be proven that he hasn't had any intent to murder and that it was entirely accidental.

(1)08 - KIDNAPPING

Kidnapping is defined as the act of unlawfully taking or seizing a person against their will.

T-1(1)08 is a felony which can get you a maximum of 100 minutes in the state correctional facility.


(1)09 - FALSE IMPRISONMENT

False imprisonment is defined as unlawfully keeping someone prisoner for a short period of time (under 60 minutes) without the intent to ask for a ransom.

T-1(1)09 is a felony which can get you a maximum of 30 minutes in the state correctional facility.


(1)10 - TORTURE

Torture is defined as intentional cause of extreme and serious body harm to another individual.

T-1(1)10 is a felony which can get you a maximum of 120 minutes in the state correctional facility.


(1)11 - MASS MURDER

Mass Murder is defined as intentional killing of several people in a shorter time period (4+ people within a short time span).

T-1(1)11 is a felony which is punishable by a death or life sentence.


(1)12 - EXTORTION

Extortion is defined as unlawful and intentional threats to another person with the intent of taking goods, money, property, service or something else of value.

T-1(1)12 is a felony which can get you a maximum of 50 minutes in the state correctional facility.


(1)13 - DOMESTIC VIOLENCE

Domestic Violence is defined as an act of violence towards a spouse, family member or close friend.

T-1(1)13 is a felony which can get you a maximum of 50 minutes in the state correctional facility.


(1)14 - HARASSMENT

Harassment is defined as persistent offensive or annoying behavior, be it physical, verbal or sexual.

T-1(1)14 is a misdemeanor which can get you a maximum of 25 minutes in a local jail.


(1)15 - HOSTAGE TAKING

Hostage taking is defined as the act of unlawfully keeping someone prisoner for a long time period (over 60 minutes) with the intent to ask for a ransom in exchange for the kidnapped individual.

T-1(1)15 is a felony which can get you a maximum of 100 minutes in the state correctional facility.


(1)16 - AIDING AND ABETTING

Aiding and Abetting is defined as the willful participation in assisting a felon to commit a crime.

T-1(1)16 is a felony which can get you a maximum of 60 minutes in the state correctional facility.


(1)17 - ACCESSORY

Accessory is defined as assisting in an of a crime (usually not willingly) but not directly partaking in the illegal activity.

T-1(1)17 is a misdemeanor which can get you a maximum of 20 minutes in a local jail.

(1)18 - RACKETEERING ACTIVITIES

Racketeering Activities is defined as participating indirectly or directly in criminal organizations that seek to violate the laws of the state.

T-1(1)18 is a felony which can get you a maximum of 50 minutes in the state correctional facility.





TITLE 2 - CRIMES AGAINST PROPERTY




(2)01 - TRESPASSING

Trespassing is defined as entering another individual's closed property without their consent.

T-2(2)01 is a misdemeanor which can get you a maximum of 15 minute(s) in a local jail.


(2)02 - TRESPASSING ON GOVERNMENT PROPERTY

Trespassing on government property is defined as entering a closed government facility.

T-2(2)02 is a felony which can get you a maximum of 30 minute(s) in the state correctional facility.


(2)03 - ARSON

Arson is defined as intentionally setting fire to any kind of property or public area.

T-2(2)03 is a felony which can get you a maximum of 60 minute(s) in the state correctional facility..


(2)04 - BURGLARY

Burglary is defined as unlawful entry of a closed property with the intent of robbery.

T-2(2)04 is a misdemeanor which can get you a maximum of 20 minute(s) in a local jail.


(2)05 - ROBBERY

Robbery is defined as taking another individual's property through the means of intimidation, assault or battery.

T-2(2)05 is a felony which can get you a maximum of 45 minute(s) in the state correctional facility..


(2)06 - ARMED ROBBERY

Armed robbery is defined as taking another individual's property with the use of a weapon.

T-2(2)06 is a felony which can get you a maximum of 60 minute(s) in the state correctional facility.


(2)07 - THEFT

Theft is defined as taking another person's property or belongings with the value of the property being between $1,000 - $10,000.

T-2(2)07 is a misdemeanor which can get you a maximum of 20 minute(s) in a local jail.


(2)08 - GRAND THEFT

Grand Theft is defined as taking another person's property or belongings which value passes over $10,000.

T-2(2)08 is a felony which can get you a maximum of 35 minute(s) in the state correctional facility.


(2)09 - GRAND THEFT AUTO

Grand Theft Auto is defined as stealing another individual's vehicle.

T-2(2)09 is a felony which can get you a maximum of 45 minute(s) in the state correctional facility.


(2)10 - FORGERY

Forgery is defined as willful alteration of documents, agreements, electronic devices etc.

T-2(2)10 is a felony which can get you a maximum of 60 minute(s) in the state correctional facility.


(2)11 - VANDALISM

Vandalism is defined as intentional destruction of public or private property.

T-2(2)11 is a misdemeanor which can get you a maximum of 20 minute(s) in a local jail.


(2)12 - LOITERING ON PRIVATE PROPERTY

Loitering on Private property is defined as the act of remaining on a private property without any particular purpose.

T-2(2)12 is an infraction which can get you a fine of $7,500 and/or a jail sentence.


(2)13 - LOITERING ON GOVERNMENT PROPERTY

Loitering on Government property is defined as the act of remaining on government property without any particular prupose.

T-2(2)13 is a misdemeanor which can get you a maximum of 10 minute(s) in a local jail.


(2)14 - FRAUD

Fraud is defined as a wrongful or criminal deception intended to result in personal or financial gain.

T-2(2)14 is a felony which can get you a maximum of 50 minute(s) in the state correctional facility.


(2)15 - MONEY LAUNDERING

Money Laundering is defined as the act of concealment of the origins of illegally obtained money, mostly by means of transfers involving foreign banks or legitimate businesses.

TITLE 3 - CRIMES AGAINST PUBLIC DECENCY




(3)01 - INAPPROPRIATE CONDUCT IN PUBLIC

Inappropriate conduct in public is defined as engaging in any sort of sexual activity within a public place.

T-3(3)01 is an infraction which can get you a fine of $5,000 and/or a jail sentence.


(3)02 - INDECENT EXPOSURE

Indecent exposure is defined as exposing a naked body or genitalia in public.

T-3(3)02 is an infraction which can get you a fine of $7,000 and/or a jail sentence.


(3)03 - PROSTITUTION

Prostitution is defined as willful engagement in sexual activity in exchange for any sort of payment.

T-3(3)03 is a felony which can get you a maximum of 25 minute(s) in the state correctional facility.


(3)04 - PIMPING

Pimping is defined as aiding or supervising persons involved in prostitution or any other public decency crimes.

T-3(3)04 is a felony which can get you a maximum of 30 minute(s) in the state correctional facility.


(3)05 - SEXUAL ASSAULT

Sexual Assault is defined as verbal abuse towards another individual for the purpose of sexual arousal.

T-3(3)05 is a misdemeanor which can get you a maximum of 20 minute(s) in a local jail.


(3)06 - RAPE

Rape is defined as unlawful and forced sexual engagement with a person who is unable to defend themselves or without the other party's consent.

T-3(3)05 is a felony which can get you a maximum of 60 minute(s) in the state correctional facility.


(3)07 - SEXUAL ABUSE

Sexual abuse is defined as intentional and forced physical contact.

T-3(3)07 is a felony which can get you a maximum of 30 minute(s) in the state correctional facility.





TITLE 4 - CRIMES AGAINST PUBLIC HEALTH AND SAFETY




(4)01 - POSSESSION OF A CONTROLLED SUBSTANCE

Possession of a controlled substance is defined as being in possession of illegal narcotics which are not medical prescribed.

T-4(4)01 is a misdemeanor which can get you a maximum of 30 minute(s) in a local jail.


(4)02 - DISTRIBUTION OF A CONTROLLED SUBSTANCE

Distribution of a controlled substance is defined as intentionally selling or handing out illegal narcotics in exchange for any type of payment.

T-4(4)02 is a felony which can get you a maximum of 45 minute(s) in the state correctional facility.


(4)03 - MANUFACTURE OF A CONTROLLED SUBSTANCE

Manufacture of a controlled substance is defined as growing, harboring and making any type of substances which are unlawful and not medically prescribed.

T-4(4)03 is a felony which can get you a maximum of 60 minute(s) in the state correctional facility.


(4)04 - UNDER THE INFLUENCE OF A CONTROLLED SUBSTANCE

Under the influence of a controlled substance is defined as current usage of narcotics without the proper permits and prescriptions.

T-4(4)04 is a misdemeanor which can get you a maximum of 30 minute(s) in a local jail.


(4)05 - PUBLIC INTOXICATION

Public Intoxication is defined as being under the influence of alcohol in public. This also includes being in possession of alcohol in a public area.

T-4(4)05 is a misdemeanor which can get you a maximum of 15 minute(s) in a local jail.


(4)06 - TERRORISM

Terrorism is defined as an attack on a grand scale against the public, a government building/place with the intent to cause major fear.

T-4(4)06 is a felony which results in a death penalty.





TITLE 5 - CRIMES AGAINST PUBLIC PEACE




(5)01 - DISTURBING PEACE

Disturbing peace is defined as intentional and willful attempt to cause a major disturbance of peace in a local public area by provoking, inciting and promoting any type of argument.

T-5(5)01 is a misdemeanor which can get you a maximum of 10 minute(s) in a local jail.


(5)02 - PUBLIC ENDANGERMENT

Public Endangerment is defined as directly or indirectly putting the public at risk or serious harm through various types of actions (shooting, recklessly driving etc).

T-5(5)02 is a misdemeanor which can get you a maximum of 30 minute(s) in a local jail.


(5)03 - INCITING A RIOT

Inciting a riot is defined as unlawful and willful attempt to deliberately cause the start of a non-peaceful riot.

T-5(5)03 is a felony which can get you a maximum of 60 minute(s) in the state correctional facility.


(5)04 - JAYWALKING

Jaywalking is defined as walking or crossing the street in a manner that could disrupt the flow of traffic or even create potential accidents.

T-5(5)04 is an infraction which can get you a fine of $7,000 and/or a jail sentence.


(5)05 - AFFRAY

Affray is defined as a fight or brawl between two people in a public place which can disrupt peace.

T-5(5)05 is a misdemeanor which can get you a maximum of 15 minute(s) in a local jail.





TITLE 6 - CRIMES AGAINST JUSTICE




(6)01 - OBSTRUCTION OF JUSTICE

Obstruction of justice is defined as intentionally preventing LEOs from performing their duties.

T-6(6)01 is a misdemeanor which can get you a maximum of 20 minute(s) in a local jail.


(6)02 - BRIBERY

Bribery is defined as a (un)successful attempt at offering valuables to a peace officer to avoid a punishment.

T-6(6)02 is a felony which can get you a maximum of 60 minute(s) in the state correctional facility.


(6)03 - CONTEMPT OF COURT

Contempt of court is defined as failure to follow direct orders from a judge, failing to show up at a court case if requested or failing to respond to a subpoena.

T-6(6)03 is an infraction if civil contempt which can get you a $5,000 fine, or a misdemeanor if criminal contempt which can get you a maximum of 30 minute(s) in a local jail.


(6)04 - IMPERSONATION

Impersonation is defined as intentionally attempting to deceive someone into thinking you're either someone else or a part of a government agency.

(6)05 - EVADING

Evading is defined as unlawfully escaping police.

T-6(6)05 is a misdemeanor which can get you a maximum of 30 minute(s) in a local jail.


(6)06 - ESCAPING POLICE CUSTODY

Escaping police custody is defined as unlawfully escaping from a local prison or jail.

T-6(6)06 is a felony which can get you a maximum of 120 minute(s) in the state correctional facility.


(6)07 - DISCOURAGING A WITNESS/VICTIM

Discouraging a witness/victim is defined as intentional attempt to harm, discourage, manipulate a victim or a witness.

T-6(6)07 is a felony which can get you a maximum of 60 minute(s) in the state correctional facility.


(6)08 - TAMPERING WITH EVIDENCE

Tampering with evidence is defined as intentional manipulation, destruction and covering of evidence.

(6)09 - GOVERNMENT CORRUPTION / POLICE MISCONDUCT

Government corruption is defined as any unlawful act or abuse committed by a law enforcement official for personal gain.

(6)10 - NEGLIGENCE

Negligence is defined as failure to take appropriate care that often has results and (in)directly affects another party.

(6)11 - FAILURE TO COMPLY

Failure to Comply is defined as a failure, refusal or neglect to obey a direct official order issued by a law enforcement officer.

(6)12 - PERJURY

Perjury is defined as the offence of willfully giving false information or making a misinterpretation under an oath.

Concealing your identity is defined as covering your face with anything or disguising your voice with the intent of concealing your identity from authorities.

TITLE 7 - VEHICLE LAWS




(7)01 - DRIVING WITHOUT A LICENSE

Driving without a license is defined as operating any sort of motor vehicle without the proper valid documentation.

T-7(7)01 is a misdemeanor which can get you a maximum of 30 minute(s) in a local jail.


(7)02 - RECKLESS DRIVING

Reckless driving is defined as driving with no regard to public safety, with no proper care.

T-7(7)02 is a misdemeanor which can get you a maximum of 30 minute(s) in a local jail.


(7)03 - HIT AND RUN

Hit and run is defined as (un)intentional hitting of another individual with a vehicle and leaving the scene.

T-7(7)03 is a misdemeanor which can get you a maximum of 30 minute(s) in a local jail.


(7)04 - VEHICULAR ASSAULT

Vehicular assault is defined as an intentional attempt to cause serious harm to another person with the use of a motor vehicle. This includes repeated ramming.

T-7(7)04 is a felony which can get you a maximum of 45 minute(s) in the state correctional facility.


(7)05 - ILLEGAL PARKING

Illegal Parking is defined as leaving your vehicle in a place not deemed for legal parking, or in a place that can obstruct the flow of traffic.

T-7(7)05 is an infraction which can get you a fine of $5,000 and/or a jail sentence.


(7)06 - ILLEGAL SHORTCUT

Illegal Parking is defined as driving through a section of the city that isn't meant to be used for travel, like a private driveway.

T-7(7)06 is an infraction which can get you a fine of $6,000 and/or a jail sentence.


(7)07 - RIDING A 2-WHEELER WITHOUT A HELMET

Riding a 2-wheeler without a Helmet is defines as driving any 2-wheeler (bicycles do not apply) without having a safety helmet on.

T-7(7)07 is an infraction which can get you a fine of $7,500 and/or a jail sentence.


(7)07 - ILLEGAL MODIFICATIONS

Illegal Modifications is defined as having any unnecessary mods on your vehicles. For example; NOS canisters, hydraulics, neon, anything that obstructs the view of the license plate (custom spoilers) .etc.

T-7(7)07 is an infraction which can get you a fine of $8,000 and/or a jail sentence.


(7)08 - SPEEDING

Speeding is defined as driving a motor vehicle faster than the defined speed limit. The speed limit for regular roads is 55 mph and 100 mph for highways.

T-7(7)08 is an infraction which can get you a fine of $10,000 and/or a jail sentence.


(7)09 - ILLEGAL RACING

Illegal Racing is defined as partaking in a motor vehicle race without a government-issued permit for such an event.

T-7(7)09 is a misdemeanor which can get you a maximum of 20 minute(s) in a local jail.


(7)10 - DRIVING UNDER INFLUENCE

Driving under Influence is defined as operating a motor vehicle while under the influence of alcohol or narcotics.

T-7(7)10 is a misdemeanor which can get you a maximum of 20 minute(s) in a local jail.


(7)11 - JOYRIDING

Joyriding is defined as an action or practice of driving fast and dangerously with no particular goal or destination, other than for the thrill of it.

T-7(7)11 is a felony which can get you a maximum of 40 minute(s) in the state correctional facility.





TITLE 8 - GUN CONTROL




(8)01 - POSSESSION OF AN UNLICENSED FIREARM

Possession of an unlicensed firearm is defined as possessing a legal firearm without a license. These firearms include: Deagle, Colt 45, Shotgun, Rifle.

T-8(8)01 is a misdemeanor which can get you a maximum of 35 minute(s) in a local jail.


(8)02 - POSSESSION OF AN ILLEGAL FIREARM

Possession of an illegal firearm is defined as possessing a firearm that is not branded legal even with a weapon license. These firearms include: Assault Rifles, Sniper Rifles, Combat Shotguns, Sub-Machine guns, silenced firearms etc.

T-8(8)02 is a felony which can get you a maximum of 40 minute(s) in the state correctional facility.


(8)03 - UNLAWFUL DISCHARGE OF A FIREARM

Unlawful discharge is defined as firing a weapon without a proper cause or reason.

T-8(8)03 is a misdemeanor which can get you a maximum of 30 minute(s) in a local jail.


(8)04 - UNLAWFUL DISTRIBUTION OF FIREARMS

Unlawful distribution is defined as illegal selling/giving away of weapons without a license.

T-8(8)04 is a felony which can get you a maximum of 35 minute(s) in the state correctional facility.


(8)05 - BRANDISHING A FIREARM

Brandishing is defined as carrying an unconcealed weapon in public, causing panic and potential harm. Even with a license, you may not open-carry.

(8)06 - UNLAWFUL MANUFACTURE OF FIREARMS

Unlawful manufacture of firearms is defined as making illegal weapons without a proper license and permit.

(8)07 - POSSESSION OF UNLICENSED WEAPON PARTS

Possession of Unlicensed Weapon parts is defined as carrying illegal materials that can be used in crafting unlicensed firearms.

(8)08 - DISTRIBUTION OF UNLICENSED WEAPON PARTS

Distribution of Unlicensed Weapon parts is defined as the sale of illegal materials that are used in crafting unlicensed firearms.

TITLE 9 - MISCELLANEOUS CRIMES




(9)01 - MISUSE OF 911

Misuse of 911 is defined as a prank or false call over the 911 hotline.

T-9(9)01 is an infraction which can get you a fine of $7,500 and/or a jail sentence.


(9)02 - FCC VIOLATION

FCC Violation is defined as usage of public advertisements in an unlawful or abusive manner, for example, as a means to try and traffic illegal items.

TITLE 10 - CRIMES AGAINST THE STATE




(10)01 - TAX EVASION

Tax Evasion is defined as the illegal evasion of payment of taxes by non-payment, underpayment or deliberately misinterpreting the true state of affairs to authorities to reduce tax liability (( stacking /signcheck's )).

(10)02 - EMBEZZLEMENT

Embezzlement is defined as the act of withholding funds for the purpose of stealing it instead of using the funds for its designated purpose.

T-10(10)02 is a felony which can get you a maximum of 120 minute(s) in the state correctional facility.


(10)03 - ESPIONAGE

Espionage is defined as the act of releasing confidential information of the state, without the consent of the government.

T-10(10)03 is a felony which can get you a maximum of 180 minute(s) in the state correctional facility.


(10)04 - TREASON

Treason is defined as the act of levying war to the state, adhering to its enemies, giving them aid or comfort by attempting to kill government officials or overthrow the government, or by releasing confidential information.

T-10(10)04 is a felony which is punishable by a death or life sentence.


(10)05 - INSUBORDINATION

Insubordination is defined as an act of defiance of the authority. A refusal to obey orders from the state government executives.
